Please read all these terms and conditions (Terms and Conditions).

As we can accept your entrance into one of our competitions and make a legally enforceable agreement without further reference to you, you must read these terms and conditions to make sure that they do not contain any provisions that you are not happy with.

  1. Application

    1. These Terms and Conditions will apply to the paid entrance into one of our Competitions by you (the Entrant or you). We are Fantasy Monster Ltd, a company registered in Scotland under number SC613583, whose registered office is at Kings Park House, Laurelhill Business Park, Stirling, Scotland, FK7 9JQ (Fantasy Monster or us or we).

    2. These are the terms on which we provide access to our competitions to you. By entering any competition, you agree to be bound by these Terms and Conditions.

    3. We reserve the right to amend these Terms and Conditions from 2me to 2me upon no2fica2on to you by e-mail to the e-mail address associated with your account and updated versions will be applicable upon publication on this Website. Please check them whenever you enter one of our Competitions to ensure that you are familiar with and in agreement with the current version.

  2. Eligibility

    1. Subject to clause 2.2 below, the Competitions are open to all persons aged 18 and residents of the United Kingdom who successfully register a user account with us. Persons under the age of majority or who reside outside of the United Kingdom are not eligible to enter our Competitions.

    2. Fantasy Monster's employees, persons with significant control in Fantasy Monster (Connected Persons), or members of the immediate family of Connected Persons, agents, or any other person who is connected with the creation or administration of our Competitions are not permitted to enter any Competition.

    3. You hereby acknowledge that by accepting these terms and conditions, you confirm that you are not breaching any laws in your country of residence by participating in a Competition online via the Website. Fantasy Monster will not be held responsible for any Entrant entering any of our Competitions unlawfully. If in any doubt, you should immediately leave the Website and check with the relevant authorities in your country of residence.

Definitions

Authorised User means any individual, natural person who is authorised by Fantasy Monster to use the Website and enter Competitions.

Authorised User Account means an account (together with login details) which entitles an Authorised User to access and use the Website in accordance with these Terms and Conditions.

Competition(s) means the competitions of skill advertised on the Website that we supply Entrance to you as requested and subject to these terms and conditions;

Durable Medium means paper or email, or any other medium that allows information to be addressed personally to the recipient, enables the recipient to store the information in a way accessible for future reference for a period that is long enough for the purposes of the information, and allows the unchanged reproduction of the information stored;

Entrance means the Entrant's request to enter a Competition through Fantasy Monster as submitted following the step by step process set out on the Website (Enter and Entered shall be construed accordingly);

Platform means our website www.fantasy.monster and any associated domains or sub-domains including any mobile or desktop software applications on which the Competitions are advertised;

Privacy Policy means the terms which set out how we will deal with confidential and personal information received from you via the Website;

Prize means any prize awarded to a Winner by Fantasy Monster;

Winner means any Entrant who wins a Prize in a Competition in accordance with these Terms and Conditions.

  1. Authorised User Accounts

    1. Before you are able to enter any Competition, you will be required to register for an Authorised User Account in your name only via the Website and signify agreement to these Terms and Conditions and our Privacy Policy. You may sign up using Google, Apple, or email.

    2. You remain responsible for all actions and security in relation to your Authorised User Account, and we suggest that you maintain a strong password to protect your Authorised User Account. Any information that you submit in registration of your Authorised User Account must be accurate, and you may only have one account associated with you. If we discover that you have attempted to register more than one account on the Website or that any data you have provided to us is inaccurate or misleading, we reserve the right to terminate your Authorised User Account immediately without prior notice to you.

    3. In order to approve your application for an Authorised User Account, we may require:

      1. Your name;

      2. Your email address;

      3. Proof of age and identification in the form of a passport or driving license;

      4. Proof of address like a utility bill or bank statement; and

      5. In certain circumstances, we may ask you for source of funds information to fulfil our anti-money laundering (AML) obligations.

    4. We retain and use all information strictly under the Privacy Policy.

    5. If you only wish to enter free Competitions without Prizes, you will only need to submit your name and email address. If you wish to enter Competitions with Prizes, we will ask you for additional information to comply with our Know Your Client (KYC) obligations.

    6. We use a third-party service to carry out our AML checks. While we reserve the right to overrule and reject any application approvals recommended by our provider, we will not overrule or approve any rejections they recommend.

    7. You will receive a confirmation email of your order and Competition entries after entering. Information about all competitions you have entered is available on the Website.

    8. By entering one of our Competitions, you expressly agree to us storing your personal information in our database and contacting you by using email or other electronic communication methods to inform you about the Competition you have entered or future Competitions that you may wish to enter. You may withdraw your consent at any time by contacting us.

    9. By accepting any Prize, all Winners agree to have their likeness recorded, processed, and stored in a Durable Medium for the purposes of future participation in promotional materials. We may make such recordings at the time of the win and once more in the future, unless prohibited by law. You may withdraw your consent at any time by contacting us.

    10. Following receipt and verification of the details requested by us, Winners will be contacted in order to make arrangements for the transfer of any Prize.

    11. We reserve the right at all times to close Authorised User Accounts if we believe any provisions of these Terms and Conditions have been breached by you, including, but not limited to, instances where an Authorised User Account is associated with any criminal activity, fraud, or the use of such devices as bots or any software we deem to be taking unfair advantage of the Competition and other Entrants.

  2. Entrance

    1. You can enter the Competitions online via the Website.

    2. Availability and pricing of Competitions are at the discretion of Fantasy Monster and will be specified at the point of sale on the Website.

    3. The description of the Competitions is as set out on the Website or any other form of advertisement.

    4. We reserve the right, in our sole discretion, to extend the closing date of any Competition if, for any reason, any aspect of the Competition is not capable of running as planned, including by reason of suspension of real-life events, infection by computer virus, network failure, bugs, tampering, unauthorised intervention, fraud, technical failures, or any cause beyond our control which corrupts or affects the administration, security, fairness, integrity, or proper conduct of the Competition. We may, in our sole discretion, cancel, terminate, modify, or suspend a Competition, or invalidate any affected entries.

    5. In the event that we close a Competition early, the Winner may be selected from all valid and eligible entries received by us prior to the date of closure, SAVE THAT we reserve the right to close a Competition early without selecting a Winner. In the event that a Competition is closed without selecting a Winner, we will give all Entrants a credit to enter future Competitions.

  3. We may make changes to any Competition which are necessary to comply with any applicable law or safety requirement. We will notify you of these changes.

  4. Payments

    1. We take payments via debit card and BACS transfer only via the Website. Credit cards are not permitted. To make a payment you will be required to set up an approved payment method which must be verified and accepted by us.

    2. If you have a deposit limit in place set either by us or yourself, you shall not be permitted to transfer funds that supersede such limits.

    3. We at all times reserve the right to impose limits on deposits at our discretion.

    4. Withdrawals are only available to be requested to your existing payment methods.

    5. Refunds on any amounts paid for Entrance can be requested up until four (4) hours before the Competition commences.

    6. Chargebacks, reversals or attempts to cancel any payment deposited on the Website are not permitted. If we become aware that an Entrant has sought or received a chargeback, we will take additional actions. Any Authorised User Account which is subject to a chargeback will be blocked and may result in your account being immediately and permanently excluded from the Website.

  5. Winners

    1. We will attempt to contact Winner(s) using the telephone numbers and email address provided at the time of Entry (or as subsequently updated) and held securely in our database. It is the Entrant's sole responsibility to check and update these details. If for any reason we have recorded your details incorrectly, we will not be held responsible. Entrants must carefully check their contact details have been recorded correctly.

    2. If for any reason we are unable to contact a Winner within 5 days of the end of a Competition; or the Winner fails to accept the Prize; or the Winner is disqualified as a result of contravening any of these Terms and Conditions, the Winner will forfeit the Prize and it will be awarded to the Entrant with the next highest score in the Competition. For the avoidance of doubt, once the Prize has been forfeited the original Winner will have no right to make further claims against us.

    3. In the event that a Competition results in a draw between two or more Entrants, the total value of the Prizes available for the 2nd places will be split between the 2nd Entrants. For example, if 2nd place in a Competition awards a prize of £500 and 3rd place awards a prize of £200, the total prizes are £700. If there are two Entrants who are 2nd for 2nd place, each would receive £350.

  6. Responsible gambling

    1. Fantasy Monster takes its responsible gambling obligations very seriously and works hard to ensure that it is in full compliance with its regulatory and legal obligations in order to protect its Entrants and ensure that its Competitions are compliant with gambling laws and regulations. Our tools include, but are not limited to:

      1. Deposit limits - Daily, weekly and monthly

      2. Take a break - 24 hours, 48 hours, 72 hours, 7 days, 30 days

      3. Self-exclusion - 6 months, 1 year, 2 years, 3 years, 4 years, 5 years, permanent

    2. In order to make use of any of our gambling control tools or to ask us about these features, please contact us.

    3. You can enter the Competitions online via the Website.

Assignment

We may transfer the benefit of these Terms and Conditions to someone else, and will remain liable to the other for its obligations hereunder. Entrants may not transfer the benefit or obligations that may arise under these Terms and Conditions to any third-party.

  1. Circumstances beyond the control of either party

    1. In the event of any failure by a party because of something beyond its reasonable control:

      1. the party will advise the other party as soon as reasonably practicable; and

      2. the party's obligations will be suspended so far as is reasonable, provided that that party will act reasonably, and the party will not be liable for any failure which it could not reasonably avoid.

  2. Privacy

    1. Your privacy is critical to us. We respect your privacy and comply with the General Data Protection Regulation with regard to your personal information.

    2. These Terms and Conditions should be read alongside, and are in addition to our policies, including our Privacy and Cookies Policy.

    3. For the purposes of these Terms and Conditions:

      1. 'Data Protection Laws' means any applicable law relating to the processing of Personal Data, including, but not limited to the Data Protection Act 2018 and the Directive 95/46/ EC (Data Protection Directive) or the GDPR.

      2. 'GDPR' means the General Data Protection Regulation (EU) 2016/679.

      3. 'Data Controller', 'Personal Data' and 'Processing' shall have the same meaning as in the GDPR.

    4. We are a Data Controller of the Personal Data we Process in providing the Competitions to you.

    5. Where you supply Personal Data to us so we can provide the Competitions to you, and we Process that Personal Data in the course of making the Competitions available to you, we will comply with our obligations imposed by the Data Protection Laws:

      1. before or at the time of collecting Personal Data, we will identify the purposes for which information is being collected;

      2. we will only Process Personal Data for the purposes identified;

      3. we will respect your rights in relation to your Personal Data; and

      4. we will implement technical and organisational measures to ensure your Personal Data is secure.

    6. For any enquiries or complaints regarding data privacy, please contact us.

  3. Intellectual Property

    1. We are the owner or the licensee of all intellectual property rights in our Website, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.

    2. ‘Fantasy Monster’ is an unregistered trade mark and is protected in the United Kingdom by the law of ‘passing off’. No right is granted to third-parties to reproduce this mark.

    3. Our status (and that of any identified contributors) as the authors of content on our Website must always be acknowledged.

    4. You must not use any part of the content on our Website for commercial purposes without obtaining a licence to do so from us or our licensors.

  4. Reliance on our Website

    1. The content on our Website is provided for general information only and is not intended to amount to advice on which you should rely. Statistics from Opta are included on the Website, reliance on such information is entirely at your own risk and we disclaim all liability for any losses that you incur as a consequence of relying upon such information.

    2. Although we make reasonable efforts to update the information on our Website, we make no representations, warranties or guarantees, whether express or implied, that the content on our Website is accurate, complete or up to date.

    3. Where our Website contains links to other sites and resources provided by third-parties, these links are provided for your information only. Such links should not be interpreted as approval by us of those linked websites or information you may obtain from them as we have no control over the contents of those sites or resources.

  5. Prohibited use

    1. You may not use the Website for any of the following purposes:

      1. to introduce third-party software designed to give you or any other person an advantage over other Entrants;

      2. in any way which contravenes the intended use of the Website;

      3. in any way which causes, or may cause, damage to the Website or interferes with any other person's use or enjoyment of the Website;

      4. in any unlawful or fraudulent manner;

      5. to decompile or attempt to decompile any of Fantasy Monster’s proprietary software;

      6. to transmit, or to procure the transmission of any unsolicited marketing materials to us;

      7. in any way which is harmful, unlawful, illegal, abusive, harassing, threatening or otherwise objectionable or in breach of any applicable law, regulation or governmental order;

      8. to knowingly introduce viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful;

      9. to gain unauthorised access to our Website, the server on which our Website is stored or any server, computer or database connected to our Website; or

      10. making, transmitting or storing electronic copies of content protected by copyright without the permission of the owner.

    2. Any breach these provisions may result in suspension from the Website or the termination of your Authorised User Account.

    3. If you contravene this clause, we reserve the right to withdraw linking permission without notice.

  8. Limitation of liability

    1. This Website and the materials and products on it are provided "as is" and without warranties of any kind, whether express or implied. In particular, we make no guarantee on the uptime of the Website or any guarantee that the Website is error-free. To the fullest extent permissible pursuant to applicable law, we disclaim all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose and non-infringement.

    2. Subject to Paragraph 17.3 below, we shall not be liable in contract or tort (including negligence and breach of statutory duty howsoever arising), misrepresentation (whether innocent or negligent) or otherwise for any loss or damage of whatsoever kind howsoever arising suffered in connection with your use of the Website, including but not limited to: direct and indirect and consequential losses, any economic loss, loss of revenue, business, profits or business opportunities, anticipated savings or profits, loss of or damage to reputation, loss of goodwill or data, loss which was not reasonably foreseeable to both parties at the time when Entrance was made or for any punitive damages, penalties, interest or costs, (including legal and professional costs and expenses) suffered in connection with this Website or our Competitions.

    3. We do not exclude liability for: (i) any fraudulent act or omission; or (ii) for death or personal injury caused by negligence or breach of our other legal obligations.

    4. We are not liable or responsible in any way for losses that you incur as a result of the cancellation of any real-life events that affect a Competition you have entered as this is beyond our control.

Indemnity

You agree to indemnify, defend, and hold us, our agents, affiliates, subsidiaries, directors, officers, employees, and applicable third parties (e.g., all relevant partner(s), licensors, licensees, consultants, and contractors) (Indemnified Person(s)) harmless from and against any third-party claim, liability, loss, and expense (including damage awards, settlement amounts, and reasonable legal fees) brought against any Indemnified Person(s) arising out of your use of the Website and/or your breach of these Terms and Conditions. You acknowledge and agree that each Indemnified Person has the right to assert and enforce its rights under this section directly on its own behalf as a third-party beneficiary.

  1. Governing law, jurisdiction, and complaints

    1. These Terms and Conditions (including any non-contractual matters) are governed by the laws of Scotland, and the Scottish courts shall have exclusive jurisdiction to settle any dispute that may arise.

    2. We try to avoid any disputes, so we deal with complaints in the following way: If a dispute occurs, Entrants should contact us to find a solution. We will aim to respond with an appropriate solution within 5 days.

Cancellation and Refund Policy

While we encourage our users to commit to their choices, we understand that circumstances may arise where users might need to cancel their participation and request a refund.

  1. Cancellation Period: Users are entitled to cancel their participation and request a refund up to four (4) hours before the first deadline of a contest. To do so, you must communicate your decision to cancel and request a refund through a clear statement (for example, a letter sent by post or email). Please ensure you retain a copy of this communication for your records.

  2. No Refund After Deadline: Once the first deadline of a contest has passed, users will no longer be eligible for a refund under any circumstances. This is due to the competitive and time-sensitive nature of our fantasy contests, which require advanced commitment and fair play among all participants.

  3. Obligation to Report Incorrect Information: It is the responsibility of our users to verify the information on their entries. If you suspect that there is incorrect information associated with your entry, you are obligated to contact Fantasy Monster immediately. Failure to do so may negatively impact your participation in our contests and may result in forfeiture of eligibility for a refund.

  4. Refund Processing Time: In the case of approved refunds, please allow between five (5) to seven (7) working days for the refund to be processed. The exact time may vary depending on your bank's policies.

Please note that by entering a contest, you are agreeing to abide by these rules. Non-compliance with these rules may result in the forfeiture of your rights under this policy.
